Merced Council to hold study session, hearing on medical marijuana

A study session and a public hearing on medical marijuana are on the Merced City Council agenda for Jan. 4.

The study session will be held at 5:15 p.m. while the public hearing will be part of the regular 7 p.m. meeting. Both will be held in the Council Chambers on the second floor of the Merced Civic Center, 678 W. 18th St.

Gov. Brown signed three bills on Oct. 9 that created licensing and regulations on medicinal marijuana in the state. Merced has until March 1 to create ordinances and have them in place or the state regulations will go into place.

Staff presented ordinances to the Planning Commission on Dec. 9 that would ban cultivation, sale and delivery of medicinal marijuana. The Commission voted 6-0, with one Commissioner absent, to instead allow the sale of medical marijuana, delivery by licensed carriers and growing of up to 12 plants.

Council has the option to go with the Planning Commission recommendations, go with a total ban, or adopt something in between. The City can impose fees to cover its costs for regulating the medical marijuana businesses.

City Council meetings are streamed live on the Internet. A link to the live meeting is on the City's home page at The City will also add the Council video to YouTube for people that were unable to watch it live. These services are in addition to the live broadcast of the regular meeting on Comcast's Government Channel 96.

The Council agenda is posted online at and is available outside the chambers prior to the meeting. Request to Speak forms are available at the meeting or can be downloaded from the City's website. Cards must be turned in to the City Clerk in order for a person to be recognized by the Council.
